Dark and Darker is the subject of a dispute between Nexon and the development studio behind the project, Ironmace. To shake things up a bit, Ironmace’s lawyer Aaron Moss wrote a letter challenging the removal of the game from Steam.
Moss began the whole work as follows:The takedown notice is based on claims that are wholly unfounded and contain knowingly and materially misrepresentations that Dark and Darker infringes Nexon’s copyrights,From his note it is clear that he definitely does not agree with the steps that were taken against his clients. In a letter sent not only to Valve but also to the media, he disputes, among other things, that there was copyright infringement because the Nexon P3 project never took a real shape. According to him, Nexon could point to a number of other similar works: “The reality is that for every comparison Nexon offers, there are half a dozen different games with the same element, and in some cases the same asset.“
Moss commented on Nexon’s actions at the end of his letter to Valve:At best, Nexon took a few unprotected elements and spliced them together to create the illusion of a copyright infringement claim. But what it really boils down to is that Nexon doesn’t want any of its former employees to work for an independent studio developing a fantasy mining game. And Nexon will go far beyond copyright law to keep Dark and Darker from falling into the hands of the public.“
How Valve will respond to his objections is still unknown. The creators want to release Dark and Darker on Steam later this year, so they can only hope their objections fall on fertile ground.
