A former GameStop employee is suing a retailer for violating New York labor laws, according to Polygon.
That employee, Trevon Mack, filed his proposed class action lawsuit Wednesday in court for the Eastern District of New York.

In the lawsuit, Mack and his attorney argue that GameStop employees should be treated as “craftsmen,” meaning that 25% of their work involves manual labor such as organizing warehouses, moving packages, and long shifts.
GameStop currently pays workers bi-weekly, but New York Labor Code Section 191 requires companies to pay manual workers weekly. If the courts decide that GameStop employees should be classified as manual workers, the company will be found guilty of breaking the law.
If granted class activist status, Mack’s lawsuit could attract “hundreds, if not thousands” of current and former GameStop employees.
New York defines a manual worker as a “machine, worker, or laborer,” defined by the courts as a worker who typically performs “physical labor” for more than 25% of a workday. This rather broad definition often confuses companies, and similar complaints have been filed this year about Cheesecake Factory, Wal-Mart, Party City, Apple, Urban Outfitters and others. Many of these cases are still pending.
