According to lawyers, Donkey Kong should have violated King Kong’s copyright. This was rejected by Nintendo, and in a legal battle, among other things, celebrity lawyer Howard Lincoln argued that MCA Universal did not own the copyright to King Kong and used his own argument that King Kong was in fact a public domain trademark. It was thanks to this statement that MCA Universal won the lawsuit at the time. They probably forgot about it when they sued Nintendo, or they hoped that Nintendo would get scared and give up. The court ultimately dismissed the claim and MCA Universal had to pay Nintendo $1.8 million in damages.
